Neale & Janet McQuiston trading as Kitchen Coos & Ewes Ltd welcome you to our farm. We want to you have an enjoyable experience. Please read the following terms and conditions before completing your booking as these and the Booking Form are the basis of the contract between you and Kitchen Coos & Ewes Ltd.

Please note that all tours are subject to availability.

1. Definitions and Interpretation

In these terms and conditions:

Kitchen Coos & Ewes Ltd, is a Company registered in Scotland (SC618687) whose registered office is located at High Airyolland Farm, New Luce, Newton Stewart, Wigtownshire, DG8 0AU. In the text “we”, “us” and “our” shall refer to Kitchen Coos & Ewes Ltd.

“You” refers to the person engaging Kitchen Coos & Ewes to provide a service. “Service” refers to any tour booking and service provided by us and/or our nominated sub-contractors and suppliers.

The person who makes the booking or represents themselves as making the booking will be responsible for full payment to us for the price of the tour and will be deemed to have the agreement of all the other members of the party to these conditions.

Your contract is made on the terms of these booking conditions which are governed by Scottish law.

2. Deposit and Payment

To secure your booking we will require full balance of payment prior to your tour payable by credit / debit card or such other method as we may specifically request from time to time. We will not be obliged to treat your payment as made until we are in clear funds. 

The person who makes the booking or represents themselves as making the booking is responsible for full payment to us for the price of the tour (including any insurance premiums and cancellation charges) and warrants that they are properly empowered to enter into a contract on behalf of, and with the consent of, all persons for whom the booking is completed.

3. Health and Safety

You acknowledge that tours are operated on a working farm. Whilst strict health and safety procedures are adhered to, there remains an element of inherent risk whilst visiting a farm.   

Please let us know when you arrive at the farm if you have any medical conditions (including allergies) that may be relevant during your visit.  Visitors should also ensure that their tetanus inoculations are up to date.

To ensure your safety and the safety of others we request that you and your party adhere to all safety rules outlined in the safety instruction briefing on arrival. We reserve the right to remove visitors from the tour should they fail to comply with the safety instructions given. Kitchen Coos & Ewes Ltd will not be held responsible for any personal injury or loss or damage to equipment or property arising from your participation in the tour or your failure to adhere to safety instructions. 

You must ensure that you are dressed appropriately for visiting a farm and that you dress appropriately for the weather conditions. You should dress warmly during Winter and Spring months. We will not be responsible for any damage to or loss of clothing arising from your attendance on the tour.  

Children under the age of sixteen must always be supervised and accompanied by a paying adult during a tour. For safety reasons dogs must not be brought on the tour. 

4. Cancellation by Client

If you or any member of the party wish to cancel a confirmed booking, we require the person who made the booking to call the contact number on our website not less than 48 hours prior to the start of the tour.

Should you wish to forego your booked tour due to the weather, we will endeavour to provide you with an alternative date within six months. If this is not possible, we shall provide you with a full refund. 

Refunds will be processed within ten working days. Reimbursement will be made in the same format as payment was taken or another agreed method if this is not suitable.

Should you wish to cancel your tour less than 48 hours prior to the booking, do not show for the booking or do not attend the meeting point prior to the tour, then Kitchen Coos & Ewes Ltd cannot issue a refund.

5. Cancellation by Kitchen Coos & Ewes Ltd

We will do our utmost to deliver the tour which we have contracted to provide you. Kitchen Coos & Ewes Ltd reserves the right to cancel or amend any tour if minimum numbers are not met. 

In the unlikely event of us having to cancel any part of your tour due to circumstances beyond our control, we will either provide you with an alternative date within six months, or a refund if that cannot be accommodated.

In the event of snow and/or ice, or extreme wind speeds tours may be cancelled at any time for safety reasons. A full refund will be issued in any of these circumstances. 

6. Photographs

As a part of our tours there will be an opportunity for you to participate in a group photo. This is entirely voluntarily as these images will be made publicly available through Kitchen Coos & Ewes Ltd social media and website. 

If you do not wish for your photograph to be taken please let us know.

Any photographs you take whilst on a tour are for personal use only. 

7. Food & Hygiene 

You are advised to wash your hands prior to consuming any food or drink provided as part of your tour. We would ask that you advise us of any specific dietary requirements or allergies at the time of your booking. We will endeavour to accommodate your dietary requirements but cannot guarantee that suitable alternatives will be available.

 

8. Complaints

Whilst Kitchen Coos & Ewes Ltd will do everything we can to provide you with a trouble free and enjoyable tour, we understand that occasionally things can go wrong. Any complaints must be notified to Neale or Janet McQuiston no later than 48 hours from the basis for the complaint arising. Following on from this we will do what we can to resolve your disputes. 

10. Liability

The Company does not accept any liability for any loss, inconvenience or damage caused by war, threat of war, riot or civil commotion, terrorist or criminal activity, industrial disputes, natural disasters, fires, illness, weather conditions, road traffic conditions, temporary technical, electrical or mechanical breakdown, or events beyond the reasonable control of Kitchen Coos & Ewes Ltd.

11. Data protection

The information that you provide to us regarding you and members of your party will be held by us in confidence and not released to any third party saving those providing accommodation and/or activities/events for you and your party.

12. External Links

The Site may contain links to other websites, resources and/or advertisements. Kitchen Coos & Ewes Ltd cannot be held responsible for the content of any pages referenced by an external link that are not operated by Kitchen Coos & Ewes Ltd. Linked sites may open in a new window. Kitchen Coos & Ewes Ltd does not control the Linked Sites and is not responsible for their contents, including any Linked Site through which you may have gained access to the Site or to which you may gain access from the Site. Your access and use of the Linked Sites is carried out solely at your own risk. We do not accept any liability in connection with any such linked Site.

14. Enforcement of Terms & Conditions

In the event that a particular term within these conditions is deemed to be illegal, invalid or otherwise unenforceable then it shall be deleted from the terms. All remaining terms shall remain in force and continue to be binding and enforceable.
